Extension of stay: applying to stay longer than the visa allows

Extension of stay is the decision by which the exit and entry administration authority of the public security organ allows a foreigner to remain in China beyond the duration of stay specified in a visa. Article 29 of the Exit and Entry Administration Law sets when the application is filed and caps the accumulated extension. Article 14 of the Regulations on Administration of the Entry and Exit of Foreigners (State Council Decree No. 637) sets the scope of the decision. Definition

Under Article 29 of the Exit and Entry Administration Law, a visa holder whose visa specifies a duration of stay not exceeding 180 days may stay in China within that duration. Where the stay needs to be extended, the holder shall file an application with the exit and entry administration of the public security organ under the local people's government at or above the county level in the place of stay. The application is filed seven days prior to the expiry of the duration specified in the visa. The holder shall submit information on the specific application matters in accordance with relevant requirements.

If, upon examination, the reasons for extension are appropriate and sufficient, the extension shall be granted. If an extension is denied, the foreigner shall leave China on the expiry of the duration.

Under Article 29, the accumulated length of extension shall not exceed the original duration of stay specified in the visa.

What the official text says

Article 14 of the Regulations (Decree No. 637) states that a decision to extend the duration of stay specified in a visa is valid only for the current entry. The decision does not affect the number of entries or the validity period of the entry specified in the visa. The total period of extension shall not exceed the original duration of stay specified in the visa. When the duration is extended, the foreigner shall adhere to the purpose specified in the original visa and stay within the extended duration.

Article 13 of the Regulations states that a receipt of acceptance for an application for extension, change or reissuance of a visa is valid for a period not exceeding 7 days. The exit and entry administration authority shall make its decision on whether to issue the visa within the validity period of that receipt. Article 13 also states that while the applicant's passport or other international travel documents are retained for processing, the applicant may stay in China legally on the strength of the receipt of acceptance.

Section IX of the guide lists visa charging standards per person by entry type for non-reciprocal countries. Zero-entry visa: CNY 160. Single-entry visa: CNY 168. Double-entry visa: CNY 252. Multiple-entry visa valid for no more than half a year: CNY 420. Multiple-entry visa valid for no more than one year: CNY 672. Adding or reducing accompanying persons: CNY 160 per person. For reciprocal countries, section IX states that fees are charged in accordance with standards stipulated by the Ministry of Foreign Affairs. Section IX gives no separate charge for an extension of stay.
